Father's Rights

At Aleck & Jenkins we say that "we fight for
father's rights" but what does that really mean?
Is there such a thing as father's rights? The answer is yes and no.
There is nothing in the law that is specifically called fathers
rights. Instead the law speaks about the rights of parents and of
the children. A father is a parent who unfortunately gets
subordinated to the other parent not because of what the law
actually says but because sometimes courts apply the law in a way
that favors the mother.
When the parties are equal in their parenting abilities, typically
our argument regarding fathers rights is that even if the court
feels that a father has no rights, the child certainly does have
rights and a child deserves both a mother and a father. A child in
our view cannot be parented by any parent on an every other weekend
basis. Even a court would have to stretch unbelievably to assert
that a parent can effectively parent a child only four days a month.
However, there are times when the father is clearly the better
choice, and when that happens, our firm certainly thinks that the
child has a right to have him as the custodial parent. The law
supports that too because the law in Michigan puts the best interest
of the child at the forefront of all considerations in establishing
who gets custody of the children. |
